Santa Check-In

Terms of Use

Effective: 20 October 2026 · Last updated: 20 October 2026 · Published by Pomsoft LLC · Contact: santacheckin.help@gmail.com

Thanks for using Santa Check-In. These Terms are short. Please read them.

1. Apple's license plus these Terms

Santa Check-In is licensed to you under Apple's Standard Licensed Application End User License Agreement (the "Apple EULA," at apple.com/legal/internet-services/itunes/dev/stdeula). These Terms add a few app-specific points. If anything here conflicts with the Apple EULA, the Apple EULA controls. Our Privacy Policy explains how the app handles information (in short, everything stays on your iPhone).

2. Who uses the app

Santa Check-In is meant to be set up and managed by a parent, guardian, or other adult caregiver (18 or older, or the age of majority where you live). Children may use Kid Mode with your permission and supervision. You're responsible for who can use your device and its passcode.

3. A little make-believe

Santa Check-In is for family fun and encouragement. The letters are written by you, the grown-up, and presented as if they came from Santa. The app doesn't contact Santa, the North Pole, or anyone else. When your child taps "Send my list to Santa," the list stays on your iPhone and appears only in Parent Mode. Nothing is mailed or sent. Please keep the magic kind.

4. Your content

You own the letters, notes, voice recordings, and wish-list items you create ("your content"). They're stored only on your device. We can't see, review, or recover them.

You're responsible for your content and for anything you choose to share using the iOS share sheet. Please: - Write kind, age-appropriate messages, and don't use the app to frighten, shame, or harm a child or anyone else. - Only record voices with permission, and don't include sensitive personal details you wouldn't want on a device or in a backup. - Use the app lawfully and don't try to copy, modify, reverse-engineer, or misuse it except as the law allows.

5. Free features and the one-time unlock

The app is free to download and includes a limited free plan (currently 3 letters in total, including Quick Santa Notes, and 1 child profile). Santa's Workshop Unlock is a one-time, non-consumable in-app purchase (price shown in the app, $4.99 in the U.S.). It isn't a subscription and never renews. It adds unlimited letters, more children, voice notes, scheduled letters, and extra letter tones.

6. Your data and backups

Because everything is stored only on your iPhone, deleting the app or losing the device can permanently erase your letters, wishes, and recordings. We can't restore them. Use iCloud or computer backups if you want a copy.

7. Our app and brand

The app, its design, artwork, animations, text templates, and the Santa Check-In name and logo belong to Pomsoft LLC or its licensors and are protected by law. These Terms don't give you any rights to them beyond using the app as allowed by the Apple EULA.

8. Disclaimers

The app is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the app will be uninterrupted or error-free, or that a scheduled letter or notification will arrive at an exact moment (for example, if your device is off or notifications are turned off). We're not responsible for content you write or share, or for how anyone reacts to it.

9. Limitation of liability

To the fullest extent the law allows, Pomsoft LLC won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for the app and in-app purchases in the 12 months before the claim. Some places don't allow certain limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer-protection laws that can't be waived.

10. Apple

These Terms are between you and Pomsoft LLC, not Apple. Apple isn't responsible for the app or its content. Apple has no obligation to provide maintenance or support for it, and Apple and its subsidiaries are third-party beneficiaries of the Apple EULA, as described there.

11. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules, except where the law of your country or state of residence requires otherwise.

12. Changes

We may update these Terms from time to time. We'll post the new version here and change the "Last updated" date. If a change is significant, we'll also mention it in the app's release notes. Continuing to use the app after an update means you accept the updated Terms.
